1. About TreatPass

TreatPass is a digital experience gifting platform (We enable the purchase and redemption of digital gift cards for spa, wellness, restaurant and group experience services across Africa, including Nigeria, Kenya, Ghana, South Africa and other territories where we operate. By accessing mytreatpass.com or using any TreatPass product or service, you ("Buyer", "Recipient", "User") agree to be bound by these Terms of Service ("Terms"). 2. Gift Card Purchase Terms

2.1 What You Are Buying When you purchase a TreatPass gift card, you are purchasing a digital voucher that entitles the recipient to book an experience at a participating TreatPass partner venue. Gift cards are not cash, store credit, or a contractual entitlement to any specific venue — they entitle the holder to book from the available network of active partner venues at the time of redemption. 2.2 Delivery Gift cards are delivered digitally via email or WhatsApp to the address or number you provide. Delivery is typically instant and in all cases within 24 hours of confirmed payment. TreatPass is not liable for non-delivery caused by incorrect contact details provided by the Buyer, spam filters, or network outages outside our control. 2.3 No Expiry TreatPass gift cards do not expire. The Recipient may redeem their card at any time. 2.4 Value and Currency Gift cards are denominated in the currency of the country selected at purchase — Nigerian Naira (₦), Kenyan Shillings (KSh), Ghanaian Cedis (GHS), South African Rand (ZAR), or as otherwise stated. The stated value is fixed at purchase and is not subject to exchange rate fluctuation. 2.5 Non-Refundable Gift card purchases are non-refundable except where required by applicable consumer protection law. In exceptional circumstances (e.g. a confirmed technical error on our side), TreatPass may at its sole discretion offer a replacement card or credit. Requests must be made within 14 days of purchase. 2.6 Non-Transferable for Cash Gift cards may not be exchanged for cash, resold for profit, or used for any unlawful purpose. Fraudulent use will result in immediate cancellation without refund. 2.7 Partner Venue Network Gift cards may only be redeemed at active TreatPass partner venues. The list of partner venues is maintained on our website and may change over time as venues join or leave the network. TreatPass makes reasonable efforts to maintain an adequate network in each territory but does not guarantee the availability of any specific venue. If a venue closes or becomes unavailable after purchase, TreatPass will offer a comparable alternative or a replacement card of equal value. 2.8 Lost or Stolen Cards TreatPass is not responsible for lost, stolen, or unauthorised use of gift cards once delivered. Please keep card details secure.

3. Redemption Terms

3.1 Booking Process Recipients redeem their gift card by following the link provided in their digital card, selecting a venue from the active network, choosing a date and time, and confirming their booking directly with the venue. 3.2 Venue Policies When a Recipient books with a partner venue, they also agree to that venue's individual policies on cancellation, rescheduling, and conduct. TreatPass is not responsible for any venue-specific terms that apply during or after booking. 3.3 No-Shows and Late Cancellations If a Recipient fails to attend a booked experience without providing advance notice to the venue, the gift card value may be forfeited at the venue's discretion. TreatPass is not liable for forfeited value arising from the Recipient's actions. 3.4 Rescheduling Recipients may reschedule bookings directly with the partner venue subject to availability and the venue's rescheduling policy. 3.5 Group Experiences For group experience bookings, the organiser is responsible for providing accurate participant numbers and ensuring all participants meet any requirements specified by the experience host. Minimum group sizes may apply.

4. Corporate Orders

4.1 Bulk Purchases Corporate clients may place bulk orders for gift cards with custom denominations. Orders of 10 or more cards are eligible for corporate pricing. A formal invoice will be issued for all corporate orders. 4.2 Payment Terms Corporate invoices are payable within 7 days of issue unless otherwise agreed in writing. Late payment may result in orders being held or cancelled. 4.3 Custom Branding TreatPass may offer branded gift card templates for qualifying corporate clients. Branding requests must be submitted in advance and are subject to design approval. 4.4 Refunds on Corporate Orders Unused corporate gift cards may be refunded within 30 days of purchase where the Recipient has not yet initiated any redemption process. Partial refunds on partially used bulk orders are assessed on a case-by-case basis. 4.5 Liability For corporate orders, TreatPass's total liability shall not exceed the total value of the order in question.

5. Detty December and Curated Packages

5.1 Package Composition TreatPass Detty December packages and other curated packages include a combination of gift card credits, experience bookings, accommodation, transfers and other components as described on the relevant package page. Each package page constitutes the definitive description of what is included. 5.2 Booking Deadlines Curated packages have strict booking lead times as stated on each package page. TreatPass cannot guarantee package availability for bookings made after the stated deadline. 5.3 Accommodation and Third-Party Services Where packages include hotel stays, transfers, or event tickets sourced through third parties, TreatPass acts as an intermediary only. TreatPass is not responsible for the acts or omissions of third-party service providers, including but not limited to hotels, transport providers, or event organisers. 5.4 Cancellations Package cancellations made more than 14 days before the start date are eligible for a 70% refund. Cancellations within 14 days are non-refundable except where the cancellation is caused by TreatPass's failure to deliver a component of the package. 5.5 Force Majeure If a package component becomes unavailable due to events outside TreatPass's reasonable control (including natural disasters, civil unrest, venue closure, or government restrictions), TreatPass will offer a comparable alternative or credit to the value of the affected component.

6. Payments

6.1 Payment Methods TreatPass accepts local and international payment methods including debit/credit cards, bank transfer, mobile money (MTN, Airtel, M-Pesa), and other methods displayed at checkout. Available methods vary by territory. 6.2 Payment Processing Payments are processed by our licensed payment service providers. By making a payment, you agree to the payment processor's terms of service in addition to these Terms. TreatPass does not store full card details. 6.3 Failed Payments If a payment fails, no gift card will be issued. If a payment is later reversed by a payment provider (chargeback), TreatPass reserves the right to cancel the associated gift card immediately. 6.4 Pricing All prices are displayed inclusive of any applicable taxes unless otherwise stated. TreatPass reserves the right to update pricing at any time. Price changes do not affect orders already confirmed.

7. User Conduct

You agree not to: — Use TreatPass for any unlawful, fraudulent or abusive purpose — Purchase gift cards using stolen or unauthorised payment credentials — Attempt to manipulate, reverse-engineer or exploit any part of our platform — Use automated systems or bots to place orders — Resell TreatPass gift cards at a markup without our written consent — Harass, threaten or abuse our staff, agents or partner venues — Circumvent any verification or security process Violation of these conduct rules may result in cancellation of your orders, suspension of access, and where appropriate, reporting to relevant authorities.

8. Intellectual Property

All content on mytreatpass.com — including the TreatPass name, logo, design, copy, photography and code — is the intellectual property of TreatPass or its licensors. You may not reproduce, copy, distribute or create derivative works from any TreatPass content without written permission. User-submitted content (such as photos or reviews submitted to us) remains your property, but by submitting it you grant TreatPass a non-exclusive, royalty-free, worldwide licence to use, display and share it in connection with our services.

9. Limitation of Liability

To the fullest extent permitted by applicable law: — TreatPass's total aggregate liability to you for any claim shall not exceed the value of the specific transaction giving rise to the claim. — TreatPass is not liable for any indirect, incidental, consequential or punitive damages, including loss of profits, loss of data, or reputational damage. — TreatPass is not liable for the quality or conduct of partner venues, third-party service providers, or any experience booked through our platform. — Nothing in these Terms excludes liability for fraud, wilful misconduct, death or personal injury caused by negligence, or any liability that cannot be excluded under applicable law.

10. Governing Law and Jurisdiction

These Terms are governed by the laws of England and Wales. Where you are a consumer resident in Nigeria, Kenya, Ghana or South Africa, you also benefit from the mandatory consumer protection provisions of your local jurisdiction which cannot be excluded by these Terms. For consumers in Nigeria, disputes may also be referred to the Federal Competition and Consumer Protection Commission (FCCPC) in accordance with the FCCPC Act 2018. For consumers in Kenya, relevant consumer protections under the Consumer Protection Act (Cap 506) apply. For consumers in Ghana, the Consumer Protection Agency Act 2022 applies where relevant. For consumers in South Africa, the Consumer Protection Act 68 of 2008 applies where relevant. Where you are a UK resident, these Terms comply with the Consumer Rights Act 2015 and the Consumer Contracts Regulations 2013. Disputes that cannot be resolved informally will be referred to the courts of England and Wales, or your local courts where required by law.

11. Changes to These Terms

TreatPass may update these Terms from time to time. We will notify users of material changes via email or a notice on our website. Your continued use of the service after changes take effect constitutes acceptance. The date at the top of this page reflects the most recent update.
